Terms of Service

1. These terms

These Terms of Service (“Terms”) govern your use of hotspot.earth (the “Service”), operated by Neuf et demi(SAS), 52 rue Georges Lafont, 44300 Nantes, France (“we”, “us”). By creating an account or making a purchase, you agree to these Terms.

2. Accounts

You must be at least 16 years old to create an account, or the minimum age of digital consent in your country, whichever is higher. You are responsible for keeping your credentials confidential and for all activity on your account. One person, one account; no shared logins.

You agree to provide accurate information and to keep it up to date. We may suspend or close accounts that violate these Terms.

3. Buyers

When you purchase a map, you receive a personal, non-transferable, lifetime licence to access and view that map’s content on hotspot.earth. “Lifetime” means for as long as the Service is operated. You may not resell, redistribute, or publish the contents.

Refunds. Because purchased maps are digital content delivered immediately upon payment, you expressly acknowledge losing your right of withdrawal under Article L221-28 13° of the French Consumer Code as soon as the map is unlocked. As a goodwill measure we offer a 7-day refund window from the date of purchase if the map is demonstrably different from its description, contains broken content, or you were charged in error. Request refunds at sebastien@neufetdemi.com. Disputes about the subjective quality of curation (“I didn’t like the restaurants”) are not grounds for a refund.

4. Creators

To sell maps, you must complete Stripe Connect onboarding. Stripe — not us — handles identity verification, payouts, and tax reporting. Stripe’s Connected Account Agreement applies to you in addition to these Terms.

Revenue share. Creators receive 90% of the purchase price of each map, net of Stripe processing fees. We retain a 10% platform fee on the gross amount. Stripe processing fees are deducted before payout according to Stripe’s published pricing.

Payouts are handled by Stripe on the schedule configured in your connected account (typically rolling daily or weekly). We do not custody creator funds.

Your content, your responsibility. You keep ownership of your maps. You grant us a worldwide, non-exclusive licence to host, display, and deliver your content to buyers, and to use short excerpts and previews for promotion of the Service. You warrant that you have the rights to all content you publish (photos, text, data) and that it does not infringe third-party rights.

Pricing. You set the price. Prices are charged in the currency you select. You are responsible for declaring your revenue to the competent tax authorities in your country of residence.

5. Prohibited content and conduct

You may not publish, sell, or request maps that contain or facilitate:

• illegal activity, hate speech, harassment, or incitement to violence;
• sexual content involving minors, or any content that sexualises minors in any way;
• doxxing, stalking, or revealing locations of private residences without consent;
• copyrighted content you don’t have a licence to distribute;
• malware, scams, or directions to illegal goods or services.

We may remove content and close accounts that breach this section without notice. Repeated or serious violations will result in forfeiture of any pending payouts to the extent permitted by law.

6. Intellectual property

The Service, its interface, code, branding, and the Hotspot name are owned by Neuf et demi. Creator content is owned by the respective creator. Buyer licences are limited to personal access; no rights are transferred.

7. Termination

You may close your account at any time from your settings. We may suspend or terminate your access if you materially breach these Terms, if we’re required to by law, or if we cease operating the Service.

If we shut the Service down, we will give registered users at least 30 days’ notice and process outstanding creator payouts through Stripe before closure.

8. Disclaimers and liability

Hotspot is a marketplace. We don’t visit every place listed by creators and make no warranty as to the accuracy, availability, or quality of the locations recommended. Use your own judgement.

To the maximum extent permitted by law, our aggregate liability to you for any claim arising from the Service is limited to the greater of (a) the total amount you paid us in the 12 months preceding the claim, or (b) 100 euros. Nothing in these Terms limits liability that cannot be limited under French law (including gross negligence, wilful misconduct, or statutory consumer rights).

9. Changes to the Terms

We may update these Terms. If a change is material, we’ll notify registered users by email at least 15 days before it takes effect. Continued use after the effective date constitutes acceptance.

10. Governing law and jurisdiction

These Terms are governed by French law. Any dispute that cannot be resolved amicably falls under the exclusive jurisdiction of the courts of Nantes, France, subject to mandatory consumer protection rules that may grant consumers a choice of venue in their country of residence.

Consumers residing in the EU may also use the European Commission’s Online Dispute Resolution platform.
